Modi Govt Gives the last notice to Twitter
The Ministry of Electronics and Information Technology, Government of India has sent a final notice to Twitter for non-compliance with the new rules under the IT Act.
Earlier on May 26 and 28, the government had sent notices to Twitter on the same issue. Replies to these notices were also given by Twitter, which the ministry has not found satisfactory.
The notice, sent on June 5, reads, "The Ministry of Electronics and Information Technology is disappointed that in your reply to the Ministry on 28 May and 2 June, you have neither given the clarification sought by the Ministry and Nor has it shown any commitment to follow the rules."
"It is
clear from your reply that Twitter has not yet provided any information about
the mandatory Chief Compliance Officer based on the new rules. Also, the
Resident Grievance Officer and Nodal Contact Person nominated by you are not
employees of Twitter in India. The Twitter office address you have given is
also that of an Indian law firm. This is also against the rules."
What's
in the notice?
The
notice read, "The new rules applicable to important social media
organizations have come into effect from May 26, 2021 and a week has passed since they came
into force, but Twitter has refused to comply with these rules. Twitter will
have to face the consequences for not following the rules."
"According
to the notice, if Twitter does not comply with these rules, the exemption given
to it by virtue of section 79 of the IT Act for being an intermediate platform will be
forfeited. This has also been clearly mentioned in Rule 7 "
In this
notice, India has also mentioned the history of Twitter's operation.
It
read, "Non-adherence to these rules shows that Twitter is not serious
about providing a safe environment for Indians on its platform. India, the
world's largest democracy, was one of the first countries, apart from the US,
where Twitter Opportunities were given in an encouraging manner."
